New York Attorney General Faces Scrutiny Over Appointment to Investigate Cornell Fraternity Rape Allegations

August 14, 2026

New York’s top law‑enforcement officer, Letitia James, has been thrust back into the spotlight after Governor Kathy Hochul named her special prosecutor for a high‑profile alleged gang rape case at a Cornell University fraternity house. The appointment has sparked debate over James’s prior handling of sexual‑misconduct claims involving her former chief of staff and her recent public comments on the victim.

A Long‑Standing Legal Battle

The controversy traces back to 2021, when Sofia Quintanar, then Deputy Press Secretary for Governor Hochul, alleged that Ibrahim Khan—James’s longtime chief of staff—had forcibly kissed her at a Brooklyn fundraiser. Quintanar claimed James had ignored warning signs and allowed Khan to leave the office “quietly” while she was not kept informed of the investigation.

Quintanar filed a civil lawsuit in 2022, accusing James of shielding Khan and misleading the press. In February 2025, a New York judge dismissed the suit against James and the Attorney General’s Office, a decision that an appellate court upheld in May 2026. The appellate ruling found that Quintanar failed to prove James had actual knowledge of Khan’s alleged misconduct.

Despite the dismissal, the lawsuit was not entirely quashed: a federal civil‑rights claim against Khan was allowed to proceed, and retaliation claims involving Khan and James’s re‑election campaign were revived.

The Cornell Fraternity Case

In October 2024, Hochul announced James’s appointment as a special prosecutor after expressing “lost faith” in the local district attorney’s handling of the alleged gang rape involving seven men at a Cornell fraternity. The decision was met with mixed reactions. Some praised the Governor’s confidence in James, while others questioned whether her past involvement in the Quintanar case compromised her ability to remain impartial.

James issued a statement on October 1 affirming her office would conduct a “full and fair” investigation, guided by facts and law. “The Governor has entrusted my office with this investigation, and we do not take that responsibility lightly,” she said. She also reiterated a message she posted to the victim on X on September 28, describing the alleged assault as “horrific and unacceptable,” and pledging to stand with survivors.

Calls for Recusal

An attorney representing one of the defendants, Gillio Lopes, filed a petition on October 7 requesting James’s removal. Andrew Miltenberg, Lopes’s lawyer, cited James’s public statements on X that appeared to sympathize with the victim and argued that such comments might bias potential jurors or influence the outcome of the case.

“Public comments by a prosecutor can jeopardize the impartiality of the investigation and the integrity of the criminal process,” Miltenberg wrote. He argued that James’s remarks raised doubts about her ability to independently evaluate evidence and decide whether criminal charges should be filed.

Former federal prosecutor Neama Rahmani echoed these concerns. “It is problematic for a prosecutor to comment publicly on a case before the investigation is concluded,” he told Fox News Digital. “If charges are eventually filed, the remarks could taint the jury pool.”

Political Reactions

Governor Hochul defended her decision. In an October 2 news conference, she said, “I have every confidence in our Attorney General to look at the facts, examine the record and draw the proper conclusions.” She also expressed full support for James’s appointment.

On social media, fraud investigator Sam Antar criticized the appointment, tweeting, “Kathy Hochul lost faith in the local DA’s handling of the Cornell sexual assault case. So she picked Letitia James. Did you read Sofia Quintanar’s lawsuit, Governor?” He added, “You’re entitled to question the DA’s handling of Cornell… We’re entitled to question James’s handling of her own aide.”

Lattina Brown, who previously posted about Quintanar on X, urged New Yorkers to remember the former staffer: “What about justice for former staffer Sofia Quintanar? She spoke out about sexual harassment and NY AG Letitia James had this woman blacklisted in the entire state of NY. Where is the support for the Hispanic woman?”

Context of Past Allegations

James’s office first learned of Quintanar’s allegations on October 2, 2022. The following day, Khan was directed to work remotely, and an outside law firm was hired to investigate. The investigation ultimately substantiated Quintanar’s claims, leading to Khan’s resignation in November 2022.

Earlier, in 2014, a former employee, Angel Dubose, alleged she was drugged and assaulted at a holiday party while James was New York City’s public advocate. The Manhattan District Attorney and the New York City Department of Investigation closed their probes without filing charges. James later described the allegations as “unsubstantiated.” A New York Post article in 2017 linked Khan to the incident, but the paper later retracted the report after Dubose could not recall an attacker.

Looking Ahead

The Cornell investigation has entered a critical phase. While Governor Hochul and some supporters back James’s appointment, defense attorneys and activists continue to call for recusal. The outcome will likely hinge on whether James can maintain public confidence in her impartiality while navigating the complex history of sexual‑misconduct allegations that have shadowed her office for years.

The state’s legal community remains watchful as the investigation unfolds, with many awaiting the next court filing to determine whether James will remain at the helm of the Cornell case or step aside for an independent prosecutor.
